Premio connects Providers (people who need services) with Servicers (professionals who deliver them). By using Premio, you agree to these Terms. Please read them carefully. Questions? Contact us at legal@premio.inc.
1. Acceptance of Terms
By downloading, installing, or using the Premio mobile application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, do not use the App. These Terms constitute a legally binding agreement between you and Premio Technologies Private Limited ("Premio", "we", "us", or "our"), a company incorporated under the laws of India.
We reserve the right to modify these Terms at any time. We will notify you of material changes through the App or by email. Your continued use of the App after such changes constitutes acceptance of the revised Terms.
2. Description of Services
Premio is a two-sided marketplace platform that:
- Enables Providers (individuals or businesses seeking home services) to post service requests and discover local professionals.
- Enables Servicers (independent service professionals) to discover service opportunities, submit quotes, and accept bookings.
- Facilitates communication, price negotiation, payments, and reviews between Providers and Servicers.
Premio does not directly provide home services. We are a technology platform that facilitates connections between independent parties. Servicers are independent contractors, not employees, agents, or representatives of Premio.
3. User Accounts and Eligibility
3.1 Eligibility
You must be at least 18 years of age to use the App. By using the App, you represent and warrant that you meet this requirement and that all information you provide is accurate, current, and complete.
3.2 Account Registration
To access most features, you must register using your mobile phone number. You are responsible for maintaining the confidentiality of your account credentials (including your PIN) and for all activities that occur under your account. You agree to notify us immediately at support@premio.inc if you suspect any unauthorized use of your account.
3.3 Account Types
Premio offers two primary account types:
- Provider Account: For individuals or businesses seeking home services.
- Servicer Account: For professionals offering home services. Servicers may be required to complete identity verification (Aadhaar KYC) before accepting paid bookings.
Role selection is permanent once confirmed in a production environment. Contact support to request a role change.
4. Provider Terms
4.1 Posting Service Requests
Providers may post service requests describing the work needed, location, urgency, and budget. You agree that all information in your service requests is accurate and not misleading. You must not post requests for illegal activities or services prohibited by applicable law.
4.2 Selecting and Paying Servicers
When you select a Servicer, you enter into a direct contract with that Servicer for the described services. Premio is not a party to this contract. You agree to pay the agreed amount through the Premio platform using the integrated payment gateway (Razorpay). Payments made outside the platform are not covered by Premio's dispute resolution process.
4.3 Cancellations by Provider
You may cancel a service request before a Servicer is confirmed at no charge. Cancellations after confirmation but before work begins may incur a cancellation fee as specified in the App. Once work has commenced, no cancellation is permitted without mutual agreement.
5. Servicer Terms
5.1 Independent Contractor Status
You acknowledge and agree that you are an independent contractor and not an employee, partner, or agent of Premio. You are solely responsible for all tax obligations, insurance, licenses, and compliance with applicable laws relating to your services.
5.2 Accuracy of Profile
You agree to provide accurate information about your skills, experience, qualifications, and availability. Misrepresentation of your capabilities or credentials may result in immediate account suspension.
5.3 Service Quality and Conduct
You agree to:
- Perform services with reasonable skill and care, consistent with industry standards.
- Treat all Providers and their property with respect.
- Comply with all applicable health, safety, and legal requirements.
- Not solicit Providers to transact outside the Premio platform.
- Maintain appropriate insurance coverage for the services you provide.
5.4 Payouts
Premio processes Servicer payouts via RazorpayX to your registered UPI ID or bank account. Payouts are initiated after the Provider confirms payment. Premio may withhold payouts pending resolution of disputes or verification issues. Premio charges a platform fee on each transaction as disclosed in the App.
6. Payments and Fees
All payments are processed through our integrated payment gateway, Razorpay. By making a payment, you agree to Razorpay's Terms of Service available at razorpay.com. Premio charges a platform service fee on each completed transaction, the current rate of which is displayed in the App before confirmation.
All prices are inclusive of applicable GST unless stated otherwise. Premio issues a GST-compliant invoice for platform fees collected.
7. Disputes and Refunds
7.1 Provider-Servicer Disputes
In the event of a dispute between a Provider and Servicer, both parties agree to first attempt resolution directly. If direct resolution fails, either party may raise a formal dispute through the Premio Dispute Centre within 24 hours of the incident.
7.2 Refund Policy
Refunds are considered on a case-by-case basis and are subject to Premio's Refund Policy. Refund requests must be submitted within 24 hours of the disputed transaction. Approved refunds are processed within 5–7 business days to the original payment method.
7.3 Platform Role
Premio acts as a neutral facilitator in disputes. Our decisions on dispute outcomes are final and binding. Premio is not liable for the quality, safety, legality, or fitness of services provided by Servicers.
8. Ratings and Reviews
Both Providers and Servicers may leave reviews after a completed service. Reviews must be honest, relevant to the service experience, and must not contain defamatory, obscene, or harassing content. Premio reserves the right to remove reviews that violate these guidelines. Attempting to manipulate the review system (e.g., fake reviews, review extortion) may result in account termination.
9. Prohibited Conduct
You agree not to:
- Use the App for any unlawful purpose or in violation of any applicable law or regulation.
- Impersonate any person or entity or misrepresent your affiliation with any person or entity.
- Upload or transmit any content that is defamatory, obscene, threatening, or otherwise objectionable.
- Attempt to gain unauthorized access to any part of the App or its related systems.
- Use automated means (bots, scrapers) to access the App without our prior written consent.
- Engage in price manipulation, fake bookings, or fraudulent activity.
- Solicit or accept payment for services outside the App to avoid platform fees.
- Harass, abuse, or harm another user in any way.
10. Intellectual Property
All content within the App, including but not limited to logos, design, software, text, and graphics, is the property of Premio Technologies Private Limited or its licensors and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for its intended personal, non-commercial purpose.
By submitting content (profile photos, task descriptions, reviews) to the App, you grant Premio a worldwide, royalty-free license to use, reproduce, and display such content for the purpose of operating and improving the platform.
11. Limitation of Liability
To the maximum extent permitted by applicable law, Premio shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App or services obtained through the App. Premio's total liability for any claim arising from these Terms or your use of the App shall not exceed the platform fees paid by you in the 3 months preceding the claim.
Premio does not guarantee the quality, safety, or reliability of any services provided by Servicers. You use the App and engage with Servicers at your own risk.
12. Indemnification
You agree to indemnify, defend, and hold harmless Premio, its officers, directors, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any services you provide or receive through the App.
13. Termination
Premio reserves the right to suspend or terminate your account at any time, with or without notice, for conduct that we determine violates these Terms, is harmful to other users, or is detrimental to the Platform. You may terminate your account at any time through the App settings or by contacting support@premio.inc.
Upon termination, your right to use the App ceases immediately. Provisions of these Terms that by their nature should survive termination (including intellectual property, limitation of liability, and dispute resolution) shall survive.
14. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana, India.
For disputes below INR 50,000, both parties agree to attempt resolution through online mediation facilitated by Premio before approaching courts.
